By accessing and using the website of Apagan Investments Ug (the "Website") or engaging with our procurement and supply services, you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.
Apagan Investments Ug is a registered entity under the Uganda Registration Services Bureau (URSB). Our services are primarily intended for B2B (Business-to-Business) transactions within the Republic of Uganda. By requesting a quote or placing an order, you warrant that you are legally capable of entering into binding contracts on behalf of your business entity.
While we strive to meet all delivery timelines specified in our agreements, Apagan Investments Ug shall not be held liable for delays caused by circumstances beyond our reasonable control, including but not limited to severe weather, supplier shortages, transportation strikes, or government actions (force majeure). We will communicate any anticipated delays proactively.
We guarantee that all goods supplied meet the agreed-upon specifications. Upon delivery, the client or their designated representative must inspect the goods. Any claims regarding defective items, shortages, or non-conformity must be reported in writing within 48 hours of delivery. Accepted returns will be replaced or credited in accordance with our return policy guidelines.
The Site and its original content, features, and functionality (including but not limited to all information, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Apagan Investments Ug and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
In no event shall Apagan Investments Ug, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
These Terms shall be governed and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
